Terms of service

The following is the contractual document that will govern the hiring of products and services through the website www.aceitesducoy.com, owned by Ducoy Olive Oil S.L. (hereinafter the provider). Acceptance of this document implies that the user:

Has read, understands, and comprehends what is stated here.

Is a person with sufficient capacity to contract.

Assumes all obligations set forth herein.

These conditions will have an indefinite period of validity and will be applicable to all contracts made through the provider's website www.aceitesducoy.com.

The provider reserves the right to unilaterally modify said Conditions, without this affecting the goods or promotions that were acquired prior to the modification.

 

Identity of the parties

On one hand, the provider of the goods or services contracted by the user is Ducoy Olive Oil S.L., with registered office at Calle Albuera 4, Mérida. CP. 06800 Badajoz, with VAT number (C.I.F) B91818369 and customer service telephone +34 679672540; and on the other,

The user, registered on the website by means of a username and password, over which they have full responsibility for use and custody, being responsible for the veracity of the personal data provided to the provider.

 

Object of the Contract

The purpose of this contract is to regulate the contractual purchase-sale relationship born between the provider and the user at the moment the latter accepts the corresponding box during the online contracting process.

The contractual purchase-sale relationship entails the delivery, in exchange for a determined price publicly displayed through the website, of a specific product or service.

 

CONTRACTING PROCEDURE

In order to access the services offered by the provider, the user must register through the website by creating a user account. To do this, the user must freely and voluntarily provide the personal data that will be requested.

The user will select a username and a password, committing to make diligent use of them, and not to make them available to third parties, as well as to communicate to the provider the loss or theft of the same or possible access by an unauthorized third party, so that the provider may proceed with immediate blocking.

The user may not choose as a username words intended to confuse others by identifying the user as a member of the provider, nor foul-sounding or injurious expressions, and in general, those contrary to the law or the requirements of morality and good customs.

Once the user account has been created, it is reported that in accordance with the requirements of Art. 27 of Law 34/2002 on Services of the Information Society and Electronic Commerce, the contracting procedure will follow the following steps.

In any case, the provider's contracting platform will inform the user, once the contracting procedure has been completed, via email regarding all the characteristics, price, forms of transport, date of contracting, and estimated delivery of the contracted product or service.

 

Delivery of orders

The delivery of orders will be made at the delivery address freely designated by the user. As such, the provider assumes no responsibility when the delivery of the product or service does not take place as a result of the data provided by the user being false, inaccurate, or incomplete, or when delivery cannot be carried out due to reasons beyond the control of the shipping company assigned for that purpose, such as the absence of the recipient.

Notwithstanding the foregoing, the provider must adopt the measures required of a diligent merchant so that delivery can be carried out within the agreed time, and if not, as soon as possible, to the satisfaction of both the sender and the recipient, and therefore no responsibility can be imputed against the provider.

Price and validity period of the offer

The prices indicated for each product include Value Added Tax (VAT) or other taxes that may be applicable and in all cases will be expressed in Euro currency (€). These costs, unless expressly stated otherwise, do not include shipping, handling, packaging, shipping insurance, or any other additional services and annexes to the product or service purchased.

The prices applicable to each product will be those published on the website and applied automatically by the contracting process in its last phase. The customer assumes that in any case the economic valuation of some of the products may vary in real time. In any case, this will always be communicated previously to users.

Every payment made to the provider will entail the issuance of an invoice in the name of the registered user. Said invoice will be automatically sent to the email address provided by the user, as well as sent along with the purchased product.

In any case, the order number assigned and indicated in the purchase confirmation email must be stated in the subject of the message or to the customer service agent.

 

Methods of payment

The user can pay through different modalities:

• Paypal

Applicable law and jurisdiction

These conditions will be governed or interpreted in accordance with Spanish legislation in matters not expressly established. The provider and the user agree to submit any controversy that may arise from the provision of the products or services object of these Conditions to the Courts and Tribunals of the user's domicile.

In the event that the user has their domicile outside of Spain, the provider and the user expressly waive any other forum, submitting to the Courts and Tribunals of the city of Mérida (Spain).
